FMS PLUS NINE Ltd
Entity Number: 142084
Trust Company Complex, Ajeltake Road, Ajeltake Island

Responsibility for Content Distributed Through the Service
The service operator acknowledges its responsibility, to the extent required under applicable law, for the administration of content made available for download through the mmodownload.com infrastructure.
Accordingly, any legal claim, complaint, copyright allegation, intellectual property notice, cease-and-desist communication, request for removal, court correspondence, regulatory inquiry or other legal matter concerning content distributed directly through mmodownload.com should be addressed to the service operator rather than to third-party infrastructure, connectivity, hosting, network, transit, CDN, domain-name or other technical service providers used in connection with the operation of the Service.
The involvement of any third-party infrastructure provider in transmitting, caching, routing, storing, delivering or otherwise technically facilitating access to content available through mmodownload.com does not make such provider the publisher or operator of mmodownload.com.
Where a complaint concerns particular material made available through the Service, the service operator requests that the complainant contact the service operator directly so that the matter may be identified, reviewed and addressed appropriately.
Copyright and Intellectual Property Complaints
The service operator respects intellectual property rights and accepts notices relating to alleged infringements involving content made available through the Service.
Any copyright owner, authorized representative, legal counsel, rights-management organization or other person claiming that material available through mmodownload.com infringes copyright, trademark or other intellectual property rights may submit a written notice to the service operator.
This includes, without limitation:
- copyright infringement complaints;
- notices described or styled as DMCA notices;
- trademark infringement complaints;
- claims concerning unauthorized distribution of software or digital materials;
- requests for removal or disabling of access to particular files;
- cease-and-desist notices;
- claims relating to proprietary game assets, software, audiovisual materials, graphics or other protected works;
- court orders, injunctions and other legally binding demands; and
- inquiries from authorized governmental, regulatory or law-enforcement authorities.
All such matters should be directed to the operator of the Service at the address stated below.
Information to Include in a Copyright or Legal Notice
To enable the service operator to properly identify and review a complaint, a notice should contain sufficient information to determine the nature and basis of the claim.
Where applicable, the notice should include:
- the full legal name and contact details of the complainant;
- identification of the person or entity whose rights are allegedly affected;
- identification of the copyrighted work, trademark, proprietary material or other right claimed to have been infringed;
- the exact URL, file path, filename or other information reasonably sufficient to locate the allegedly infringing material on mmodownload.com;
- a clear explanation of the legal basis of the complaint;
- documentation demonstrating ownership of, or authority to act in relation to, the relevant intellectual property rights;
- where the notice is submitted by a representative, reasonable evidence that the representative is authorized to act on behalf of the relevant rights holder;
- any relevant court orders, registrations, licence documentation or other supporting materials;
- a statement that the information supplied in the notice is accurate; and
- the handwritten or legally valid electronic signature of the complainant or authorized representative where required by applicable law.
Incomplete, ambiguous or unsupported notices may require additional information before they can be meaningfully evaluated.
Submission of a notice does not, by itself, constitute proof that infringement has occurred, and the service operator reserves the right to review the factual and legal basis of any complaint before taking action, except where immediate action is required by a binding order or applicable law.
DMCA and Similar Notices
Where a complainant submits a notice under the United States Digital Millennium Copyright Act (“DMCA”) or refers to the DMCA in connection with content available through mmodownload.com, such notice may be delivered to the service operator at the legal correspondence address specified below.
References to the DMCA shall not be interpreted as an admission that United States law necessarily governs every activity, transaction, server, user, operator or item of content associated with the Service.
Where another jurisdiction or legal framework applies, the service operator may review the complaint under the laws and procedures applicable to the circumstances of the particular matter.
Nothing in this notice constitutes a waiver of any jurisdictional objection, defence, limitation of liability, procedural right or other legal right available to the service operator.
Notices Directed to Infrastructure Providers
For the avoidance of doubt, mmodownload.com may rely upon independent companies for services such as internet connectivity, server hosting, colocation, content delivery, data storage, domain registration, DNS services, network transit, DDoS mitigation or other technical infrastructure.
Such technical providers operate independently from the service operator and, unless expressly stated otherwise by them, are not responsible for selecting, publishing or controlling the content made available through mmodownload.com.
Where a complaint relates specifically to material distributed through mmodownload.com, complainants are therefore requested to direct the substantive legal complaint to the service operator, which is the appropriate point of contact for matters relating to the operation and content of the Service.
Nothing in this section is intended to interfere with any statutory rights a complainant may have against another party under applicable law.
Review of Legal Requests
The service operator reserves the right to examine any notice, complaint or legal request before taking action.
Where appropriate, the service operator may request clarification, supporting documentation, evidence of ownership, evidence of authorization or additional information necessary to evaluate the request.
The service operator may reject, dispute or seek clarification concerning notices that are fraudulent, materially incomplete, abusive, misleading, unrelated to content available through mmodownload.com or otherwise unsupported by a sufficient factual or legal basis.
Where a valid and binding court order or other enforceable legal obligation requires action with respect to particular content, the service operator will address such request in accordance with applicable law.
No Admission of Infringement
The existence of this legal-notice procedure and the service operator's willingness to receive copyright or other legal complaints must not be interpreted as an admission that any particular content made available through mmodownload.com is unlawful, infringing or unauthorized.
Any allegation of infringement remains an allegation unless and until the relevant issue is determined through an appropriate legal process or otherwise resolved between the relevant parties.
Likewise, voluntary review, temporary restriction or removal of particular material shall not necessarily constitute an admission of liability, wrongdoing or infringement by the service operator or any other person.
Preservation of Rights
The service operator expressly reserves all rights, remedies, defences and procedural protections available under applicable law.
Nothing contained in this notice shall:
- constitute an admission of liability;
- constitute consent to the jurisdiction of any particular court or country;
- waive any defence relating to jurisdiction, venue or applicable law;
- waive any statutory limitation or immunity available to the service operator;
- create contractual rights in favour of a complainant or other third party; or
- expand the service operator's legal obligations beyond those imposed by applicable law.
